These are the terms and conditions for the use of information and data provided by Experian. These terms and conditions are provided as part of the customer agreement for users of this Service.
EXPERIAN TERMS & CONDITIONS
| A. | Restrictions on Use.
Please read the following information carefully before using this web site. By using this web site, you agree to these terms and conditions. If you do not agree to these terms and conditions, you may not use this web site
ContractorCheck reports ("Reports") purchased on the ContractorCheck consumer site (www.contractorcheck.com), either directly or through affiliates, are intended for personal use only, and not for commercial use. "Commercial use" is defined as use by persons acting as employees of a business that sell to and/or extend commercial credit to contractors. Without limiting the foregoing definition, personal use of the service is defined to not ordinarily exceed 25 reports during any calendar month. ANY COMMERCIAL USE OF THE CONTRACTORCHECK REPORTS PURCHASED ON THE CONSUMER SITE IS STRICTLY PROHIBITED AND ANY SUSPECTED COMMERCIAL USE WILL LEAD TO THE DEACTIVATION OF YOUR ACCOUNT AND MAY RESULT IN LEGAL PROSECUTION. WE RESERVE THE RIGHT TO IMPOSE, AND YOU AGREE TO PAY TO EXPERIAN, AN ADDITIONAL CHARGE OF $12.95 FOR EACH CONTRACTORCHECK REPORT THAT EXPERIAN DEEMS WAS ACCESSED FOR COMMERCIAL PURPOSES. MASS DOWNLOADS OF MORE THAN 25 REPORTS ON ANY INDIVIDUAL DAY ARE PROHIBITED AND WILL BE CONSIDERED EVIDENCE OF COMMERCIAL USE. Under no conditions, may this information be used as a factor in establishing an individual's eligibility for credit or insurance purposes. Likewise, the Reports may not be resold.

| B. | Warranty Disclaimer and Limitation of Liability.
Experian's Reports are compiled from multiple sources. It is not always possible for Experian to obtain complete discrepancy information on all contractors; therefore, there may be other license, bonds, insurance policies, liens, judgments and payment records that apply to a contractor that are not reflected on that contractor’s report. Experian searches data from additional sources where possible, but all pertinent information may not be reflected on the Report.
Customer further acknowledges and agrees that the data and services:
| i.) | These reports are based on information supplied to Experian by external sources believed to be reliable, BUT NO RESPONSIBILITY IS ASSUMED BY EXPERIAN OR ITS AGENTS FOR ERRORS, INACCURACIES OR OMISSIONS. THE REPORTS ARE PROVIDED STRICTLY ON AN "AS IS WHERE IS" BASIS, AND EXPERIAN AND NETBRIDGE FURTHER EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE REGARDING THIS REPORT. |
| ii.) | YOU AGREE TO INDEMNIFY EXPERIAN AND NETBRIDGE FOR ANY CLAIMS OR LOSSES, INCLUDING COSTS, EXPENSES AND ATTORNEY FEES, INCURRED BY EXPERIAN ARISING DIRECTLY OR INDIRECTLY FROM YOUR IMPROPER OR UNAUTHORIZED USE OF CONTRACTORCHECK REPORTS. |
| iii.) | Experian shall not be liable for any delay or failure to provide an accurate Report if and to the extent which such delay or failure is caused by events beyond the reasonable control of Experian, including, without limitation, "acts of God", terrorism, or public enemies, labor disputes, equipment malfunctions, material or component shortages, supplier failures, embargoes, rationing, acts of local, state or national governments, or public agencies, utility or communication failures or delays, fire, earthquakes, flood, epidemics, riots and strikes. |
| iv.) | EXPERIAN AND NETBRIDGE DO NOT ACCEPT ANY RESPONSIBILITY FOR ANY INJURY OR DAMAGE THAT YOU MAY CAUSE TO YOURSELF, OTHERS, OR PROPERTY WHEN FOLLOWING THE INFORMATION GIVEN ON THIS SITE. Experian has no control over how you may use the information you get from the site and does not attest to the validity of any information found herein, nor does it guarantee any results. Use information found on our site at your own risk. EXPERIAN AND NETBRIDGE DO NOT MAKE ANY WARRANTIES OR GUARANTEES, EXPRESSED OR IMPLIED, ABOUT THE QUALITY OF ANY OF THE WORK A CONTRACTOR MAY PROVIDE; NOR IS EXPERIAN OR NETBRIDGE UNDER ANY DUTY TO INVESTIGATE THE QUALITY OF THE WORK PERFORMED BY A CONTRACTOR NAMED ON ANY CONTRACTORCHECK REPORT. | C. | Use of the Products.
The information, products, and services available on this web site may include technical inaccuracies or typographical errors. Experian has the right to change, modify or add to the terms and conditions governing this web site or any part thereof, the information, products or services offered through this web site. Such changes, modifications, additions or deletions shall be effective immediately upon notice thereof, which may be given by any means including posting on this web site or by other electronic or conventional means. You agree to review this page periodically to be aware of such changes, modifications, additions or deletions. Your continued use of the web site after such notice has been given shall be deemed to constitute your acceptance of the changes, modifications, additions or deletions. Experian will send emails to the email address you provide regarding notices, alerts, price changes, product updates, renewal notices or other matters specifically relating to the Services (“Email Notices”). You agree to provide Experian with your current email address for purposes of receiving product alerts and other notices. If any information you provide is untrue, inaccurate or not current, or if Experian has reasonable grounds to suspect that such information is untrue, inaccurate or not current, Experian, at its sole discretion, has the right to suspend or terminate your use of any product and refuse all current or future access to the Content and use of the products or suspend or terminate any portion thereof. Further, you agree that Experian will not be liable to you or any third party if Experian suspends or terminates your access to the content or products for any reason.
Specific products:
| i.) | Continuous subscription service. The one time $20 sign-up fee applies only to the first month of your subscription. When you purchase this subscription, you agree to have the monthly fee billed to your credit card each month on your anniversary date. The price of the monthly subscription fee is subject to change upon 30 days notice by email. You may cancel your subscription at any time. However, the $20 sign-up fee is non-refundable. If you decide to later re-subscribe at any time after the cancellation of your subscription, you will be required to pay another one time $20 sign-up fee to become a subscriber. |
| ii.) | Individual purchases of ContractorCheck reports. There are no subscription or signup fees required to purchase individual ContractorCheck reports. Report pricing is clearly marked along with purchase buttons that will complete the transaction and obligate you to the respective fees and Customer Terms and Conditions. When you use our online products to access ContractorCheck reports you are certifying that you understand and agree to the following: a) You may access the ContractorCheck report ordered for 7 days from the date of payment. b) Refund decisions are based on a case by case basis. c) If you have questions regarding your company's report or would like to dispute information, you may request an investigation by contacting an Experian representative. Use the phone listed on the web site, or use the online form, posted in the 'HELP / CONTACT US' section at the top of www.ContractorCheck.com |

| D. | Additional Terms and Notices.
| i.) | The terms and conditions herein apply to Experian Information Solutions, Inc. its parent companies, subsidiaries, affiliates, divisions, contractors, vendors, including but not limited to NetBridge Technologies, Inc, and all data sources and suppliers all of which are referred to herein as Experian. The terms and conditions are in addition to, and do not override, the specific terms and conditions that apply to this website and the products or services offered by Experian and otherwise through this site. |
| ii.) | These Experian Terms and Conditions will be governed by and construed in accordance with the internal substantive laws of the State of California, USA. The parties agree that the venue for any dispute arising out of the access to, or use by, Customer of any information or data provided by Experian shall be in Orange County, California, whether brought in federal or state court. UNDER NO CIRCUMSTANCE SHALL EXPERIAN BE GREATER THAN THE AGGREGATE AMOUNT PAID BY THE CUSTOMER TO EXPERIAN IN THE 12 MONTHS PRIOR TO ANY CLAIM. |
| iii.) | Links to other Web sites: For purposes of convenience, Experian's site contains links to third party Web sites. Experian makes no representations or warranties about any third party Web site that you may access through the links. By providing a link to those Web sites, Experian does not endorse, adopt, or otherwise accept any responsibility for the content or use of those Web sites. |
| iv.) | Trademark: Experian and the Experian products referenced in this site are either trademarks, service marks or registered trademarks of Experian Information Solutions, Inc. or its affiliates. Other products and company names mentioned herein may be the trademarks of their respective owners. No use of any Experian trademark may be made by any third party without express written consent of Experian. |

Sales tax:
In certain jurisdictions, sales tax at state and local rates may apply, in which case you may be charged the applicable taxes (at the highest local rate in your state) in addition to the monthly fee and/or price for the Services. The list of taxable states is available on the account registration page. We do not have an online method to claim tax exempt status. If you are tax exempt, you can apply to be exempted from paying sales tax on future purchases. Please FAX us your completed and signed "State Sales Tax Exemption Form" to 610-525-5063 - Attention: Scott Wilkinson, Tax Claims. We'll notify you within 2 business days of your account status. We cannot refund your tax on previous purchases. Tax exempt organizations may file for a refund of taxes on previous purchases with your state, using a receipt from us to show you have paid tax. We cannot assist you in filing these forms with your state.
